Terms and Conditions
These Terms and Conditions govern access to and use of Visit Black Travel, including its content, guides, features, communications, and related services.

1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to Visit Black Travel LLC (“Visit Black Travel,” “Company,” “we,” “our,” or “us“). These Terms & Conditions (“Agreement“) govern your use of visitblacktravel.com, any affiliated websites or booking platforms operated by Visit Black Travel, and all travel planning, booking, concierge, destination management, consulting, event, transportation, accommodation, tour, and related services offered by Visit Black Travel.
By accessing our website, requesting a quotation, submitting a reservation request, purchasing travel services, making a payment, or otherwise engaging Visit Black Travel to arrange or facilitate travel, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
If you are making reservations on behalf of additional travelers, you represent and warrant that you have the authority to accept these Terms & Conditions on behalf of every traveler included in the reservation. You further agree to provide each traveler with a copy of these Terms & Conditions and any applicable package-specific agreements. Each traveler shall be bound by this Agreement as if they had accepted it individually.
These Terms & Conditions apply in conjunction with any package-specific agreements, booking confirmations, itineraries, supplier terms, cancellation policies, waivers, or other documents provided by Visit Black Travel. In the event of a conflict, the package-specific agreement shall govern only with respect to the specific travel product or service purchased, while all remaining provisions of this Agreement shall continue to apply.
Visit Black Travel reserves the right to amend or update these Terms & Conditions from time to time. The version in effect on the date your reservation is confirmed shall govern your booking unless otherwise required by applicable law.
2. DEFINITIONS
For purposes of this Agreement, the following definitions apply:
“Visit Black Travel,” “Company,” “we,” “our,” or “us” refers to Visit Black Travel LLC, a Florida limited liability company, together with its owners, employees, contractors, travel advisors, agents, representatives, successors, and assigns.
“Traveler,” “Guest,” “Passenger,” “Customer,” “Client,” or “you” refers to any individual for whom Visit Black Travel provides travel planning, booking, consulting, or related services, whether acting individually or as part of a group.
“Supplier” means any independent third party providing travel-related goods or services, including but not limited to hotels, resorts, vacation rentals, airlines, cruise lines, rail operators, motorcoach companies, transportation providers, tour operators, destination management companies, attractions, restaurants, museums, guides, event organizers, ticket vendors, insurance providers, or other service providers.
“Travel Services” means any itinerary planning, reservations, accommodations, transportation, event packages, guided tours, excursions, travel consulting, concierge services, destination management services, ticketing, vacation packages, or other services arranged, coordinated, or facilitated by Visit Black Travel.
“Package Agreement” means any supplemental agreement governing a specific travel package, hosted group departure, event experience, promotion, or itinerary, including any package-specific payment schedules, cancellation policies, or participation requirements.
“Booking” or “Reservation” means any request accepted by Visit Black Travel to arrange Travel Services on behalf of a Client.
“Force Majeure Event” means any event beyond the reasonable control of Visit Black Travel or its Suppliers, including but not limited to acts of God, severe weather, hurricanes, floods, fires, epidemics, pandemics, public health emergencies, labor disputes, civil unrest, terrorism, war, governmental actions, transportation disruptions, utility failures, supplier insolvency, or any other circumstance that materially affects travel operations.
3. ABOUT VISIT BLACK TRAVEL LLC
Visit Black Travel LLC is a Florida-based travel company specializing in culturally enriching travel experiences that celebrate the history, heritage, entrepreneurship, creativity, and communities of the African diaspora.
Our services may include, without limitation:
- Curated vacation packages
- Boutique hotel reservations
- Heritage and cultural tourism experiences
- Group travel
- Destination management services
- Event travel packages
- Transportation coordination
- Custom itineraries
- Concierge services
- Attraction and event ticketing
- Restaurant and culinary experiences
- Educational travel
- Corporate, nonprofit, and affinity group travel
- Luxury and bespoke travel planning
Depending upon the specific reservation, Visit Black Travel may act as a travel advisor, booking agent, destination management company, reseller of travel services, organizer of proprietary experiences, or facilitator of third-party travel arrangements.
Some experiences offered by Visit Black Travel are developed, managed, or operated directly by Visit Black Travel. Others are arranged through independent Suppliers whose services are subject to their own terms, conditions, operational policies, and availability.
Descriptions, photographs, itineraries, pricing, accommodations, schedules, and amenities displayed on our website or in promotional materials are intended to provide general information and are subject to change without notice based upon Supplier modifications, operational needs, seasonal variations, or circumstances beyond our control.
4. AGENCY RELATIONSHIP AND SUPPLIER RESPONSIBILITY
Visit Black Travel acts primarily as an independent travel advisor, booking agent, and intermediary between Clients and independent Suppliers providing travel-related goods and services.
Except where expressly stated in writing, Visit Black Travel does not own, operate, manage, control, or supervise hotels, vacation rentals, airlines, cruise lines, transportation companies, tour operators, museums, restaurants, event venues, attractions, insurance providers, or any other Supplier participating in your travel experience.
Each Supplier is solely responsible for providing the products and services purchased by the Client, including accommodations, transportation, activities, meals, admissions, ticketing, and other travel components.
By purchasing Travel Services through Visit Black Travel, you acknowledge and agree that each Supplier maintains its own booking policies, cancellation rules, operating procedures, safety standards, and contractual terms, all of which remain binding upon the traveler. You agree to comply with all applicable Supplier policies during your trip.
Visit Black Travel exercises reasonable care in selecting reputable Suppliers; however, we do not warrant or guarantee the financial stability, safety, quality, suitability, availability, performance, or continued operation of any Supplier. Visit Black Travel shall not be liable for any act, omission, negligence, delay, cancellation, overbooking, schedule change, service interruption, bankruptcy, insolvency, labor dispute, equipment failure, accident, injury, illness, property damage, theft, lost baggage, denial of service, or other occurrence attributable to any independent Supplier.
Suppliers reserve the right to substitute accommodations, equipment, transportation, routes, schedules, personnel, or other travel components when operationally necessary. Such substitutions, deviations, or delays shall not constitute a breach of this Agreement by Visit Black Travel.
Visit Black Travel shall not be responsible for losses resulting from missed connections, delayed departures, airline schedule changes, weather events, governmental actions, border restrictions, transportation disruptions, or other circumstances beyond our reasonable control.
By utilizing our services, you acknowledge that Visit Black Travel serves solely as an intermediary for independent travel Suppliers and that your legal remedies for deficiencies in Supplier-provided services generally rest with the applicable Supplier rather than Visit Black Travel.
Nothing in this Agreement shall be construed as creating a joint venture, partnership, employment relationship, or agency relationship between Visit Black Travel and any Supplier.
5. BOOKINGS AND RESERVATIONS
A reservation is not confirmed until all of the following conditions have been satisfied:
- Visit Black Travel has received the required deposit or full payment, as applicable;
- Availability has been confirmed by the applicable Supplier(s);
- Any required booking documents have been completed;
- Visit Black Travel has issued written confirmation of the reservation.
Quotes, proposals, itineraries, and pricing provided by Visit Black Travel are offered as invitations to book and do not constitute confirmed reservations. Availability and pricing remain subject to change until a reservation has been confirmed in writing.
Travelers are responsible for providing complete and accurate information necessary to facilitate their reservation, including but not limited to:
- Legal name(s) exactly as they appear on government-issued identification or passports;
- Date(s) of birth;
- Mailing address;
- Email address;
- Telephone number;
- Passport information, where applicable;
- Emergency contact information when requested;
- Dietary restrictions, accessibility needs, or other special requests.
Failure to provide accurate information may result in denied boarding, denied entry, cancellation of reservations, additional Supplier fees, or other travel disruptions. Visit Black Travel shall not be responsible for costs arising from inaccurate or incomplete information provided by the Client.
Clients are responsible for carefully reviewing all booking confirmations, itineraries, invoices, hotel reservations, airline tickets, event tickets, and travel documents immediately upon receipt. Any discrepancies or requested corrections must be reported to Visit Black Travel promptly. Corrections requested after tickets or reservations have been issued may be subject to Supplier penalties, administrative fees, or may not be possible.
Visit Black Travel reserves the right to decline or cancel any reservation prior to departure for any lawful reason, including but not limited to suspected fraud, non-payment, abusive or threatening conduct, violations of these Terms & Conditions, or circumstances that could reasonably jeopardize the safety or successful operation of a trip.
6. PRICING, QUOTATIONS, TAXES, AND SURCHARGES
Unless otherwise stated, all prices are quoted in United States Dollars (USD).
All pricing is subject to availability at the time of booking. Travel pricing—including airfare, accommodations, transportation, event tickets, excursions, and vacation packages—is dynamic and may change without notice until the required deposit or payment has been received and the reservation has been confirmed.
Quoted prices may include applicable taxes, fees, or service charges where specifically identified. Unless expressly stated, prices do not include:
- Airfare;
- Passport or visa fees;
- Travel insurance;
- Baggage fees;
- Optional excursions;
- Meals not specifically listed;
- Gratuities;
- Parking;
- Resort fees;
- Personal expenses;
- Incidental hotel charges; or
- Any other item not expressly identified as included.
Visit Black Travel exercises reasonable care in preparing quotations and promotional materials. However, pricing errors, typographical mistakes, supplier transmission errors, inventory discrepancies, and technological malfunctions may occasionally occur. Visit Black Travel reserves the right to correct any pricing errors prior to confirmation of a reservation. If a material pricing error is discovered after a quote has been issued but before a reservation has been confirmed, the Client will be notified and given the opportunity to accept the corrected price or cancel the proposed reservation without penalty.
Suppliers may impose increases in taxes, government assessments, fuel surcharges, resort fees, or other mandatory charges after a reservation has been confirmed. Where permitted under Supplier agreements, such increases may be passed through to the Client. Visit Black Travel will make reasonable efforts to notify Clients of any such increases as soon as practicable.
Unless otherwise stated, promotional pricing, discounts, and special offers may not be combined and are subject to availability, blackout dates, and Supplier restrictions.
7. PROFESSIONAL PLANNING AND CONCIERGE FEES
Visit Black Travel provides professional travel planning, destination expertise, itinerary design, concierge services, and travel consulting that require substantial time, research, and specialized knowledge.
For certain reservations, custom itineraries, group travel programs, destination management services, or concierge engagements, Visit Black Travel may charge a professional planning or consultation fee. Any applicable planning fee will be clearly disclosed before services commence.
Unless otherwise stated in writing, planning fees compensate Visit Black Travel for professional services rendered and are separate from payments made to travel Suppliers.
Planning fees become earned upon commencement of professional services and are non-refundable, regardless of whether the Client ultimately books travel, modifies travel plans, or elects to cancel the proposed trip.
Visit Black Travel reserves the right to waive, reduce, or refund planning fees at its sole discretion. Any such waiver shall not constitute a continuing obligation or establish a precedent for future transactions.
Planning fees do not guarantee availability of travel services, preferred pricing, Supplier acceptance, visa approval, or the successful completion of any travel plans.
8. PAYMENTS
Payment requirements vary depending upon the travel products and Suppliers selected.
At the time of booking, Visit Black Travel will advise the Client of all applicable deposit requirements, payment schedules, and final payment deadlines.
Clients are solely responsible for ensuring that all payments are received on or before the applicable due dates. Failure to remit payment by the required deadline may result in cancellation of reservations by Visit Black Travel or the applicable Supplier, and cancellation penalties may apply.
Visit Black Travel is not responsible for reservations cancelled due to missed payment deadlines or declined payment methods.
Unless otherwise stated, deposits are applied toward the total purchase price of the reservation but may be non-refundable depending upon the Supplier’s cancellation policy or any applicable Package Agreement.
Visit Black Travel accepts payment methods designated during the booking process. By submitting payment information, the Client represents and warrants that they are the authorized user of the payment method provided and authorize Visit Black Travel to process payments for the travel services requested.
Where a payment plan has been established, the Client authorizes Visit Black Travel to process future scheduled payments using the payment method on file for the amounts and dates previously authorized, unless alternative payment arrangements are made before the scheduled payment date.
If a payment is declined, reversed, or otherwise unsuccessful, Visit Black Travel may suspend or cancel the reservation until payment has been successfully received.
Returned payments, insufficient funds, declined transactions, or other payment failures may be subject to reasonable administrative fees, together with any fees assessed by the applicable financial institution or Supplier.
Acceptance of a deposit or payment does not constitute confirmation of a reservation until Visit Black Travel has issued written confirmation in accordance with Section 5 of these Terms & Conditions.
9. PAYMENT AUTHORIZATION, ONLINE CREDIT CARD AUTHORIZATION, AND CHARGEBACK POLICY
By submitting payment through Visit Black Travel’s website, invoice, booking platform, payment portal, or any other authorized payment method, you certify and represent that you are the lawful owner or authorized user of the payment method provided.
By completing your reservation, you expressly authorize Visit Black Travel LLC to process charges using the payment method you provide for:
- Deposits required to secure your reservation;
- Final balances due under your booking;
- Scheduled installment payments authorized by you;
- Approved itinerary modifications;
- Supplier-imposed charges that you have expressly authorized;
- Additional services, upgrades, excursions, transportation, event tickets, or accommodations that you subsequently request in writing or through an approved electronic communication.
You further authorize Visit Black Travel to share payment information, when necessary, with applicable Suppliers solely for the purpose of securing and fulfilling your travel arrangements.
You acknowledge that many Suppliers impose immediate payment requirements and cancellation penalties once reservations are confirmed. Accordingly, authorized payments processed by Visit Black Travel may be immediately remitted to Suppliers and may become non-refundable in accordance with Supplier policies or any applicable Package Agreement.
If you dispute any charge, you agree to notify Visit Black Travel promptly so that we may investigate and attempt to resolve the matter in good faith.
You agree that you will not initiate or attempt to obtain a credit card chargeback, payment reversal, or similar dispute for properly authorized travel services as a means of avoiding applicable cancellation policies, Supplier terms, contractual payment obligations, or other provisions of this Agreement.
Nothing in this section limits your right to dispute charges involving actual fraud, unauthorized transactions, or billing errors as protected under applicable law.
Should an improper chargeback or payment reversal result in financial loss to Visit Black Travel, including the loss of commissions, supplier payments, processing fees, legal expenses, collection costs, or administrative expenses, Visit Black Travel reserves the right to pursue recovery of those amounts to the fullest extent permitted by law.
Electronic acceptance of these Terms & Conditions shall constitute your legally binding authorization for Visit Black Travel to process payments as described herein and shall have the same force and effect as a handwritten signature.
10. PACKAGE-SPECIFIC TERMS AND CONDITIONS
Certain travel experiences offered by Visit Black Travel—including but not limited to hosted group departures, curated vacation packages, cultural tours, sporting event packages, festivals, educational travel, cruises, and destination-specific experiences—may be governed by supplemental Package Agreements.
Each Package Agreement forms an integral part of your contract with Visit Black Travel and shall include information specific to the purchased travel experience, which may include:
- Payment schedules;
- Deposit requirements;
- Final payment deadlines;
- Minimum participation requirements;
- Hotel accommodations;
- Transportation arrangements;
- Included and excluded services;
- Event tickets;
- Activity schedules;
- Refund policies;
- Cancellation schedules;
- Traveler eligibility requirements;
- Health or safety requirements; and
- Other package-specific provisions.
By completing your reservation, you agree to be bound by both these Terms & Conditions and any Package Agreement applicable to your reservation.
Where a Package Agreement establishes cancellation policies, payment deadlines, or other requirements that differ from these general Terms & Conditions, the Package Agreement shall govern solely with respect to that specific travel package.
If no Package Agreement exists for a particular reservation, these Terms & Conditions shall govern exclusively.
11. CANCELLATIONS, REFUNDS, TRAVEL CREDITS, AND SUPPLIER PENALTIES
All cancellations must be submitted in writing by the individual who made the original reservation. Cancellation requests become effective only upon written acknowledgment by Visit Black Travel.
Cancellation requests made by telephone, text message, voicemail, social media, or through third parties shall not constitute official notice unless confirmed in writing by Visit Black Travel.
Because Visit Black Travel works with numerous independent Suppliers, cancellation penalties vary depending upon the Supplier, destination, travel dates, and services purchased.
Unless otherwise stated in a Package Agreement or Supplier policy, cancellation penalties imposed by Suppliers shall apply to all reservations.
Visit Black Travel shall not be responsible for refunding amounts that have been retained by Suppliers pursuant to their published terms and conditions.
Professional planning fees, consultation fees, concierge fees, itinerary design fees, research fees, and other service fees earned by Visit Black Travel remain non-refundable once services have commenced unless otherwise agreed in writing.
Where refunds are available, they will be processed only after funds have been received by Visit Black Travel from the applicable Supplier. Visit Black Travel cannot guarantee the timing of Supplier refunds.
Certain reservations—including but not limited to event tickets, sporting events, concerts, performances, airfare, promotional rates, custom itineraries, private experiences, and certain boutique accommodations—may be wholly non-refundable.
Where permitted by the applicable Supplier, future travel credits may be offered in lieu of cash refunds. Acceptance of any travel credit shall be governed by the terms established by the issuing Supplier.
Visit Black Travel makes no representation regarding the future financial condition of any Supplier and cannot guarantee that future travel credits issued by Suppliers will ultimately be honored.
Travelers who purchase comprehensive travel insurance may have additional rights under their insurance policy. Any insurance claims must be submitted directly to the insurance provider and remain subject to the terms of the applicable insurance policy.
12. MODIFICATIONS BY THE TRAVELER
Requests to modify confirmed reservations—including changes to travel dates, destinations, accommodations, transportation, event tickets, traveler names, occupancy, itineraries, or other travel arrangements—must be submitted in writing.
Visit Black Travel will make reasonable efforts to accommodate requested changes; however, all modifications remain subject to Supplier availability, contractual restrictions, and any applicable change fees.
Certain reservations—including airfare, event tickets, promotional rates, prepaid accommodations, and specialty travel products—may not be modified after confirmation.
Clients shall be responsible for all additional costs, Supplier penalties, fare differences, administrative charges, or other expenses resulting from requested modifications.
Any modification may require cancellation and rebooking under then-current pricing, availability, and Supplier policies.
Visit Black Travel is not responsible for losses arising from requested itinerary changes, including the forfeiture of deposits, promotional pricing, event tickets, or non-refundable travel components.
For group travel, modifications requested by individual travelers may not be possible if they adversely affect contractual obligations, minimum participation requirements, or negotiated group pricing.
All approved modifications shall become part of the original reservation and remain subject to these Terms & Conditions, together with any applicable Package Agreement.
13. CHANGES BY VISIT BLACK TRAVEL
Visit Black Travel carefully plans each itinerary with the goal of delivering the highest quality travel experience possible. However, travel is inherently dynamic, and circumstances beyond our reasonable control may require modifications before or during your trip.
Visit Black Travel reserves the right to make reasonable changes to accommodations, transportation providers, tour operators, guides, attractions, restaurants, schedules, routes, activities, meeting locations, or other travel components when necessary due to operational requirements, Supplier changes, safety considerations, weather conditions, governmental actions, Force Majeure Events, or other unforeseen circumstances.
Whenever practicable, Visit Black Travel will provide advance notice of material changes and will endeavor to substitute travel components of comparable quality and value.
Minor modifications that do not materially affect the overall character or value of the travel experience—including changes in departure times, hotel room assignments, transportation equipment, guides, restaurant selections, attraction operating hours, or sequencing of activities—shall not constitute a breach of this Agreement and shall not entitle the traveler to compensation or a refund.
If a material change substantially alters the nature of the purchased travel experience prior to departure, Visit Black Travel will use commercially reasonable efforts to offer one or more of the following, as appropriate:
- A comparable substitute itinerary or travel component;
- A future travel credit, where permitted by the applicable Supplier; or
- A refund to the extent funds are recoverable from the applicable Supplier and required under the applicable Package Agreement.
Visit Black Travel shall not be responsible for changes initiated by independent Suppliers or governmental authorities that are beyond our reasonable control.
14. TRAVEL DOCUMENTATION REQUIREMENTS
Each traveler is solely responsible for obtaining, possessing, and maintaining all documentation required for travel.
Depending upon the destination and travel services purchased, required documentation may include, without limitation:
- A valid passport;
- Required visas or travel authorizations;
- Government-issued identification;
- Vaccination records;
- Health certificates;
- Customs declarations;
- Entry permits;
- Return or onward travel documentation; and
- Any other documentation required by governmental authorities, carriers, or Suppliers.
Visit Black Travel may provide general information regarding travel documentation requirements as a courtesy; however, such information is not intended as legal or immigration advice and should not be relied upon as the sole source of information.
Documentation requirements frequently change with little or no notice. Travelers are responsible for independently verifying all passport, visa, vaccination, customs, entry, exit, transit, and health requirements directly with the appropriate governmental authorities prior to departure.
Many countries require that passports remain valid for at least six months beyond the date of entry or return. It is the traveler’s responsibility to confirm that their passport satisfies all applicable requirements.
Failure to obtain or present proper documentation may result in denied boarding, denied entry, missed departures, mandatory quarantines, deportation, cancellation of travel arrangements, or additional expenses.
Visit Black Travel shall not be responsible for any losses, expenses, delays, cancellations, penalties, or damages resulting from a traveler’s failure to obtain or maintain proper documentation.
15. HEALTH, MEDICAL FITNESS, ACCESSIBILITY, AND SPECIAL ACCOMMODATIONS
Travelers are responsible for ensuring that they are physically, mentally, and medically capable of safely participating in their selected travel experience.
Certain itineraries may involve walking, uneven terrain, stairs, extended travel days, high temperatures, water-based activities, or other physical demands. It is the traveler’s responsibility to determine whether a particular itinerary is suitable for their personal health and physical condition.
Travelers with mobility limitations, disabilities, dietary restrictions, allergies, medical conditions, or other special requirements are encouraged to notify Visit Black Travel in writing at the time of booking so that we may communicate those requests to the applicable Suppliers.
Visit Black Travel will make reasonable efforts to coordinate requested accommodations; however, because accommodations are provided by independent Suppliers, we cannot guarantee that every request can be fulfilled.
Certain historic properties, boutique accommodations, cultural sites, transportation providers, and international destinations may have limited accessibility due to their age, location, infrastructure, or local regulations.
Travelers requiring personal care, medical assistance, mobility assistance, or continuous supervision remain solely responsible for arranging such assistance throughout their travels. Suppliers may require certain travelers to be accompanied by a capable companion if necessary for health or safety reasons.
Travelers remain responsible for carrying all necessary medications, medical devices, mobility equipment, prescriptions, and personal health supplies.
Visit Black Travel assumes no responsibility for the adequacy of medical facilities available at any destination or for medical treatment received during travel.
By participating in travel arranged through Visit Black Travel, travelers acknowledge that travel involves inherent risks and voluntarily assume responsibility for determining their own fitness to participate.
16. TRAVEL INSURANCE
Visit Black Travel strongly recommends that every traveler purchase comprehensive travel insurance to protect both their financial investment and personal well-being.
Travel insurance may provide valuable protection for circumstances including, but not limited to:
- Trip cancellation;
- Trip interruption;
- Travel delays;
- Missed connections;
- Supplier insolvency;
- Lost, stolen, or delayed baggage;
- Medical emergencies;
- Emergency medical transportation;
- Emergency evacuation;
- Accidental injury;
- Illness before or during travel; and
- Other unforeseen events that may disrupt travel plans.
Although Visit Black Travel may facilitate the purchase of travel insurance through independent insurance providers or refer travelers to reputable insurance companies, Visit Black Travel is not an insurance company, insurance broker, or licensed insurance agency and does not provide insurance advice, interpret insurance policies, or determine coverage eligibility.
Travelers remain solely responsible for reviewing available insurance options and selecting coverage appropriate for their individual circumstances.
If travel insurance is declined, the traveler acknowledges and agrees that they assume full responsibility for any cancellation penalties, Supplier fees, medical expenses, emergency transportation costs, travel interruptions, baggage losses, or other financial losses that may occur before or during travel.
Visit Black Travel shall not be liable for losses that could have been reimbursed under an available travel insurance policy.
All insurance claims must be submitted directly to the applicable insurance provider in accordance with the terms and conditions of the policy purchased.
Visit Black Travel has no authority to approve, deny, process, expedite, or influence insurance claims and shall not be responsible for any claim determination, policy interpretation, denial of benefits, or actions of any insurance provider.
By accepting these Terms & Conditions, each traveler acknowledges that they have been advised of the importance of purchasing comprehensive travel insurance and have either obtained appropriate coverage, intend to obtain coverage independently, or voluntarily decline such coverage after having had the opportunity to do so.
17. TRAVELER CONDUCT
Visit Black Travel is committed to providing safe, respectful, and enjoyable travel experiences for all participants, employees, guides, partners, Suppliers, and members of the communities we visit.
Travelers are expected to conduct themselves in a courteous, respectful, and lawful manner at all times throughout their travels.
Each traveler agrees to:
- Comply with all applicable federal, state, local, and international laws and regulations;
- Follow all reasonable instructions provided by Visit Black Travel representatives, tour leaders, guides, transportation providers, accommodations, and other Suppliers;
- Treat fellow travelers, hospitality staff, local residents, and cultural sites with courtesy and respect;
- Refrain from behavior that is disruptive, abusive, discriminatory, threatening, violent, harassing, or unsafe;
- Respect the customs, traditions, cultural heritage, and laws of each destination visited;
- Avoid damaging property or causing unnecessary disruption to accommodations, transportation providers, attractions, or event venues.
Visit Black Travel reserves the right to remove or refuse participation to any traveler whose conduct, in our reasonable judgment or that of a Supplier, endangers themselves or others, interferes with the enjoyment of other travelers, violates applicable laws, damages property, or materially disrupts the travel experience.
Should removal from a tour, event, transportation service, or accommodation become necessary, the traveler shall be solely responsible for all resulting expenses, including alternative transportation, accommodations, meals, and any additional costs incurred. No refund shall be provided for unused portions of the itinerary.
Travelers remain financially responsible for any property damage, excessive cleaning fees, fines, penalties, or other charges resulting from their conduct during the trip.
Nothing in this section limits the authority of independent Suppliers to enforce their own rules, policies, or conditions of carriage.
18. EVENT TICKETS AND ADMISSION
Certain travel packages arranged by Visit Black Travel may include admission to sporting events, concerts, festivals, museums, theatrical performances, cultural experiences, conferences, or other ticketed attractions.
Unless otherwise expressly stated in writing, all event tickets are subject to the terms, conditions, and policies established by the issuing venue, promoter, organizer, or ticketing provider.
Visit Black Travel cannot guarantee the occurrence, timing, seating location, lineup, participants, performers, weather conditions, or overall experience associated with any event.
Event organizers reserve the right to:
- Reschedule events;
- Relocate venues;
- Change seating assignments;
- Modify event schedules;
- Restrict attendance;
- Substitute performers or participants; or
- Cancel events altogether.
Visit Black Travel shall not be responsible for such changes.
Unless otherwise provided under a specific Package Agreement or required by applicable law, event tickets are considered non-refundable once purchased.
Should an event be cancelled, postponed, or materially modified, any available refund, credit, or replacement ticket shall be governed solely by the policies of the event organizer, venue, or ticket issuer.
Visit Black Travel will make reasonable efforts to assist travelers in communicating with the applicable Supplier but does not guarantee refunds or replacement tickets beyond those provided by the issuing organization.
19. PHOTOGRAPHY, VIDEO, AND MARKETING RELEASE
Visit Black Travel celebrates meaningful travel experiences and may photograph or record portions of its tours, hosted events, educational programs, and group travel experiences for documentation, storytelling, and promotional purposes.
By participating in travel experiences organized or hosted by Visit Black Travel, you grant Visit Black Travel LLC and its authorized representatives a non-exclusive, worldwide, royalty-free, perpetual license to use photographs, video recordings, audio recordings, or other media in which you may appear for lawful business purposes, including:
- Website content;
- Social media;
- Printed marketing materials;
- Newsletters;
- Educational materials;
- Advertising campaigns;
- Public relations;
- Promotional videos; and
- Other marketing communications.
Such materials may be edited, reproduced, published, displayed, distributed, or otherwise used without further notice or additional compensation.
Visit Black Travel will make reasonable efforts to portray travelers respectfully and professionally and will not knowingly use images in a false, misleading, defamatory, or offensive manner.
Travelers who do not wish to appear in promotional materials must notify Visit Black Travel in writing prior to the commencement of their trip. While we will make reasonable efforts to honor such requests, we cannot guarantee that incidental appearances in crowd scenes, public events, or group photographs can always be avoided.
Nothing in this section restricts a traveler’s right to take personal photographs or videos during their travels, provided such activities comply with applicable laws, venue rules, Supplier policies, and respect the privacy and rights of other travelers.
20. INTELLECTUAL PROPERTY
All content appearing on Visit Black Travel’s website, marketing materials, itineraries, travel guides, digital publications, photographs, graphics, logos, trademarks, service marks, videos, written content, tour concepts, package designs, proprietary itineraries, educational materials, and other original works are the exclusive property of Visit Black Travel LLC or its licensors and are protected by United States and international intellectual property laws.
Except as expressly permitted by law, no portion of Visit Black Travel’s intellectual property may be copied, reproduced, republished, modified, distributed, transmitted, displayed, sold, licensed, reverse engineered, or otherwise exploited without the prior written consent of Visit Black Travel.
The purchase of travel services does not grant any ownership interest in Visit Black Travel’s intellectual property or proprietary travel concepts.
Travelers may share their personal travel photographs, reviews, and experiences on social media and other platforms, provided such content does not falsely imply sponsorship, endorsement, partnership, or affiliation beyond the travel services actually provided.
Any feedback, suggestions, testimonials, reviews, or recommendations voluntarily submitted to Visit Black Travel regarding our services may be used by Visit Black Travel for business purposes without compensation to the submitting individual, provided such use complies with applicable privacy laws.
Unauthorized commercial use of Visit Black Travel’s branding, logos, trademarks, proprietary itineraries, written materials, or marketing content is strictly prohibited and may result in legal action.
21. WEBSITE USE
Visit Black Travel grants you a limited, non-exclusive, non-transferable, and revocable license to access and use visitblacktravel.com solely for personal, lawful, and non-commercial purposes related to researching, planning, and purchasing travel services.
By using our website, you agree that you will not:
- Violate any applicable laws or regulations;
- Submit false, fraudulent, or misleading information;
- Attempt to gain unauthorized access to any portion of the website, servers, or related systems;
- Interfere with or disrupt the operation, security, or functionality of the website;
- Introduce viruses, malware, malicious code, or other harmful technologies;
- Use automated scripts, bots, crawlers, scraping tools, or similar technologies to extract data or content without our prior written consent;
- Reproduce, copy, distribute, modify, publish, or commercially exploit website content except as expressly permitted by these Terms & Conditions; or

Visit Black Travel does not guarantee that the website will operate without interruption, error, delay, or security vulnerabilities. Temporary outages may occur due to maintenance, technical issues, third-party service interruptions, or circumstances beyond our reasonable control.
Information presented on our website—including pricing, availability, itineraries, photographs, descriptions, maps, and promotional materials—is provided for general informational purposes and may be updated, modified, or removed without prior notice.
22. PRIVACY
Visit Black Travel values your privacy and is committed to protecting the personal information entrusted to us.
Our collection, use, storage, disclosure, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms & Conditions by reference.
By using our website or purchasing travel services, you acknowledge that Visit Black Travel may collect personal information reasonably necessary to arrange and manage your travel, including, where applicable:
- Contact information;
- Billing information;
- Travel preferences;
- Passport information;
- Emergency contact information;
- Dates of birth;
- Loyalty program information;
- Payment information;
- Accessibility requests;
- Dietary preferences; and
- Other information necessary to facilitate travel arrangements.
You authorize Visit Black Travel to share such information with applicable Suppliers, governmental authorities, payment processors, insurance providers, technology vendors, and other third parties only as reasonably necessary to fulfill your travel arrangements, comply with legal obligations, process payments, provide requested services, or protect our legal rights.
While Visit Black Travel employs commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information, no website, payment platform, or electronic transmission can be guaranteed to be completely secure.
Accordingly, Visit Black Travel cannot guarantee absolute security and shall not be liable for unauthorized access or disclosure resulting from circumstances beyond our reasonable control, including cyberattacks, criminal acts, failures of third-party technology providers, or other unforeseen security incidents.
Travelers are responsible for maintaining the confidentiality of any account credentials used to access our website or booking systems.
23. FORCE MAJEURE
Travel is inherently subject to circumstances beyond the reasonable control of Visit Black Travel and its Suppliers.
Visit Black Travel shall not be deemed in breach of this Agreement, nor liable for delays, cancellations, modifications, losses, damages, expenses, or failure to perform resulting directly or indirectly from any Force Majeure Event.
For purposes of this Agreement, a Force Majeure Event includes, but is not limited to:
- Hurricanes, tropical storms, tornadoes, floods, earthquakes, wildfires, or other natural disasters;
- Epidemics, pandemics, public health emergencies, quarantines, or disease outbreaks;
- Acts of terrorism, war, armed conflict, piracy, civil unrest, political instability, or governmental sanctions;
- Government orders, border closures, travel advisories, visa restrictions, or changes in immigration policy;
- Airline schedule changes, transportation interruptions, labor strikes, lockouts, or carrier insolvency;
- Supplier bankruptcy, business closure, or operational failure;
- Utility failures, communication outages, cyberattacks, or technology failures;
- Weather conditions affecting safe operation of travel services;
- Mechanical failures affecting transportation providers;
- Security threats;
- Acts or omissions of governmental authorities; or
- Any other event beyond the reasonable control of Visit Black Travel or the applicable Supplier.
If a Force Majeure Event affects a confirmed reservation, Visit Black Travel will make commercially reasonable efforts to assist travelers in obtaining available alternatives, rescheduling travel, or securing refunds or travel credits where permitted by the applicable Supplier.
However, Visit Black Travel cannot guarantee the availability of refunds, credits, substitute services, or future travel opportunities.
Travelers acknowledge that Supplier policies, travel insurance coverage, governmental regulations, and prevailing circumstances may ultimately determine the remedies available following a Force Majeure Event.
Visit Black Travel strongly encourages all travelers to obtain comprehensive travel insurance that includes appropriate coverage for unforeseen travel disruptions.
24. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Visit Black Travel LLC, together with its members, managers, officers, employees, independent contractors, affiliates, travel advisors, representatives, successors, and assigns, shall not be liable for any injury, illness, death, loss, damage, delay, inconvenience, expense, or other claim arising from or relating to:
- Acts or omissions of independent Suppliers;
- Airline delays or cancellations;
- Transportation interruptions;
- Hotel overbookings;
- Supplier insolvency;
- Mechanical failures;
- Lost, stolen, or delayed baggage;
- Theft or criminal acts committed by third parties;
- Acts of terrorism;
- Civil unrest;
- Natural disasters;
- Government actions;
- Border restrictions;
- Public health emergencies;
- Traveler misconduct;
- Force Majeure Events; or
- Any circumstance beyond Visit Black Travel’s reasonable control.
Travelers acknowledge that participation in domestic and international travel involves inherent risks, including risks that cannot be eliminated despite the exercise of reasonable care.
Visit Black Travel does not guarantee:
- The financial stability of any Supplier;
- The uninterrupted availability of travel services;
- The quality or suitability of Supplier-provided services;
- The accuracy of information provided by third parties;
- The safety of any destination;
- The availability of medical facilities;
- The actions of governmental authorities; or
- The outcome of any travel experience.
Except where prohibited by applicable law, Visit Black Travel’s aggregate liability arising from any reservation, transaction, or claim shall not exceed the total amount of professional service fees actually retained by Visit Black Travel for the reservation giving rise to the claim.
In no event shall Visit Black Travel be liable for any indirect, incidental, consequential, special, exemplary, punitive, or speculative damages, including but not limited to loss of enjoyment, emotional distress, lost profits, loss of business opportunities, or other consequential economic losses, even if advised of the possibility of such damages.
Nothing contained in these Terms & Conditions shall be construed as excluding or limiting liability that cannot lawfully be excluded or limited under applicable law.
25. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Visit Black Travel LLC, together with its members, managers, officers, employees, independent contractors, affiliates, travel advisors, agents, successors, and assigns, from and against any and all claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
- Your breach of these Terms & Conditions or any applicable Package Agreement;
- Your violation of any applicable law or regulation;
- Your negligent, reckless, intentional, or unlawful acts or omissions;
- Damage to property or injury caused by you during your travels;
- Claims brought by third parties arising from your conduct;
- Your failure to obtain or maintain required travel documentation;
- Your failure to disclose relevant medical conditions or accessibility needs that materially affect your participation; or
- Your misuse of Visit Black Travel’s website, intellectual property, or services.
Visit Black Travel reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with such defense.
Nothing contained in this section shall require you to indemnify Visit Black Travel for claims arising solely from Visit Black Travel’s own gross negligence, willful misconduct, or any liability that cannot legally be disclaimed under applicable law.
26. GOVERNING LAW AND VENUE
These Terms & Conditions, together with any Package Agreement, reservation, booking confirmation, or related travel contract, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or relating to these Terms & Conditions, your reservation, or the services provided by Visit Black Travel shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
Each party irrevocably submits to the personal jurisdiction of such courts and waives any objection based upon improper venue or forum non conveniens to the fullest extent permitted by law.
Nothing contained herein shall prevent Visit Black Travel from seeking temporary or permanent injunctive relief, equitable relief, or other remedies available under applicable law in any court of competent jurisdiction when necessary to protect its intellectual property, confidential information, business interests, or contractual rights.
27. DISPUTE RESOLUTION
Visit Black Travel values strong relationships with its travelers and believes that most concerns can be resolved through open communication and good-faith cooperation.
If a dispute arises relating to these Terms & Conditions, a reservation, or services provided by Visit Black Travel, the traveler agrees to first notify Visit Black Travel in writing, describing the nature of the dispute and the requested resolution.
The parties agree to make reasonable, good-faith efforts to resolve the matter informally before initiating litigation.
Nothing contained in this section prevents either party from seeking immediate injunctive relief where necessary to prevent irreparable harm or preserve legal rights.
Should litigation become necessary, such litigation shall proceed in accordance with Section 26 (Governing Law and Venue).
Except where prohibited by applicable law, each party shall bear its own attorneys’ fees and litigation expenses unless otherwise awarded by a court of competent jurisdiction or provided by statute.
28. SEVERABILITY
If any provision of these Terms & Conditions is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions.
The unenforceable provision shall be interpreted, modified, or limited only to the extent necessary to render it enforceable while preserving, to the greatest extent possible, the original intent of the parties.
The remaining provisions of these Terms & Conditions shall continue in full force and effect.
No waiver by Visit Black Travel of any breach or default shall constitute a continuing waiver of any subsequent breach or default.
Failure by Visit Black Travel to enforce any provision of these Terms & Conditions shall not be construed as a waiver of that provision or of any other rights available under applicable law.
These Terms & Conditions, together with any applicable Package Agreement, Privacy Policy, booking confirmation, and any written documents expressly incorporated by reference, constitute the entire agreement between Visit Black Travel and the traveler regarding the subject matter herein and supersede all prior discussions, proposals, representations, or understandings relating to the reservation.
29. ELECTRONIC ACCEPTANCE
Visit Black Travel conducts business electronically to provide a secure, efficient, and convenient booking experience.
By clicking any button, checkbox, or similar acknowledgment indicating “I Agree,” “Accept,” “Continue,” “Book Now,” “Complete Reservation,” or any comparable electronic acceptance mechanism, you acknowledge and agree that:
- You have carefully read these Terms & Conditions in their entirety;
- You understand and voluntarily accept all provisions contained herein;
- You have had the opportunity to ask questions before completing your reservation;
- You are legally authorized to enter into this Agreement;
- If booking on behalf of additional travelers, you have the authority to accept these Terms & Conditions on their behalf and agree to provide them with copies of all applicable booking documents;
- You consent to the use of electronic records, electronic communications, and electronic signatures in connection with your reservation;
- Your electronic acceptance shall have the same legal force and effect as an original handwritten signature.
Where applicable, your electronic acceptance also constitutes:
- Authorization for Visit Black Travel to process payments in accordance with Section 9 of these Terms & Conditions;
- Acknowledgment that you have been advised of the importance of purchasing comprehensive travel insurance pursuant to Section 16;
- Acceptance of any applicable Package Agreement governing your reservation; and
- Agreement to comply with all Supplier terms and conditions applicable to your travel arrangements.
By completing your reservation, you certify that all information provided is true, complete, and accurate to the best of your knowledge and that you understand these Terms & Conditions create a legally binding agreement between you and Visit Black Travel LLC.
